Terms and Conditions
Triumph Ova Struggles Advocacy and Consulting

This Agreement ("Agreement") is made between you ("Client") and Triumph Ova Struggles Advocacy and Consulting ("Provider"). By engaging the services of Triumph Ova Struggles Advocacy and Consulting, you agree to the following terms and conditions:

  1. Scope of Services
    Triumph Ova Struggles Advocacy and Consulting provides benefit counseling, consulting, advocacy, career support, and peer support services to clients. The scope of services may include but is not limited to: providing advice, guidance, emotional support, coaching, and advocacy on various personal, social, or health-related matters.

  2. Payment Terms
    • The Client agrees to pay the Provider the agreed-upon fee for services rendered, as outlined in the invoice or agreement.
    • Payments are due upon receipt of the invoice or as otherwise agreed in writing.
    • All payments are non-refundable unless otherwise stated in writing.

  3. Client Responsibilities
    • The Client agrees to provide truthful, accurate, and complete information necessary for the provision of the services.
    • The Client agrees to participate actively and in good faith in all sessions and to adhere to any guidelines or instructions provided by the Provider.

  4. No Liability
    By engaging with Triumph Ova Struggles Advocacy and Consulting, the Client acknowledges and agrees that the Provider, its employees, contractors, and affiliates shall not be held liable for any decisions, outcomes, or actions taken by the Client based on the consulting, advocacy, or peer support services provided. The Client understands that:
    • The services provided are advisory in nature and do not constitute professional legal, medical, or psychological advice.
    • Any recommendations, guidance, or support provided are based on the Provider’s best knowledge and experience.
    • The Client is solely responsible for any decisions made or actions taken based on the advice or services received.
    • The Provider makes no guarantees or promises of specific results or outcomes and shall not be liable for any damages, losses, or consequences arising from the use of the services provided.

  5. Limitation of Liability
    • To the fullest extent permitted by law, Triumph Ova Struggles Advocacy and Consulting, its employees, agents, affiliates, or contractors shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of profits, revenue, or data arising from the Client’s use of services, regardless of the cause of action, even if advised of the possibility of such damages.
    • In no event shall the total liability of Triumph Ova Struggles Advocacy and Consulting exceed the total amount paid by the Client for the services provided within the last 12 months preceding the event giving rise to the liability.

  6. Indemnity
    The Client agrees to indemnify, defend, and hold harmless Triumph Ova Struggles Advocacy and Consulting, its employees, contractors, agents, and affiliates from and against any and all claims, demands, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or related to:
    • The Client’s breach of this Agreement,
    • The Client’s use or misuse of the services provided,
    • Any action or inaction by the Client that results in harm, damage, or loss to themselves or third parties,
    • The Client’s failure to comply with applicable laws and regulations.

  7. Confidentiality
    • Triumph Ova Struggles Advocacy and Consulting is committed to maintaining the confidentiality of the Client’s personal and sensitive information.
    • All information shared between the Client and the Provider will be kept confidential unless required by law or with the Client’s express consent.

  8. Punctuality and Cancellation Policy
    • The Client agrees to arrive on time for all scheduled appointments.
    • If the Client needs to cancel or reschedule, they must provide at least 24 hours' notice to be eligible for a refund.
    • Cancellations made with less than 24 hours' notice will not be eligible for a refund, but the session may be rescheduled.
    • No-shows without prior notice will not be eligible for rescheduling or a refund.
    • Rescheduled appointments are not eligible for refunds.
    • If the Client anticipates being late, they must inform the Provider as soon as possible. If the Client is more than 15 minutes late, rescheduling may be necessary depending on availability.

  9. Termination
    Either party may terminate this Agreement at any time with written notice. In the event of termination, the Client agrees to pay for any services rendered up to the date of termination.

  10. No Guarantee of Results
    While the Provider will make every reasonable effort to assist the Client in achieving their goals, the Provider does not guarantee any specific outcome or result from the services provided. Success in any area is dependent on a variety of factors beyond the control of the Provider.

  11. Dispute Resolution
    Any disputes arising from this Agreement shall be resolved through informal negotiation or, if necessary, through mediation. The Client and Provider agree to work together in good faith to resolve any conflicts amicably.

  12. Amendments
    Triumph Ova Struggles Advocacy and Consulting reserves the right to amend or modify these Terms and Conditions at any time. The Client will be notified of any changes, and continued engagement with the services will be considered acceptance of those changes.

  13. Governing Law
    This Agreement shall be governed by and construed in accordance with the laws of New York, USA.

Declaration of Agreement

By engaging with Triumph Ova Struggles Advocacy and Consulting, I, the Client, commit to the following principles and values, which will guide our work together:

  1. Optimism
    I agree to approach the services provided by Triumph Ova Struggles Advocacy and Consulting with an open mind and a positive attitude, recognizing that growth, change, and healing are possible, even in challenging circumstances. I will strive to remain hopeful and proactive in my journey.

  2. Vulnerability
    I commit to being vulnerable in my interactions with my consultant, advocate, or peer support provider. I understand that sharing my truth, struggles, and concerns in a safe and open manner will allow me to receive the most effective support and guidance. I acknowledge that vulnerability is a strength, not a weakness, and is essential for meaningful progress.

  3. Adaptability
    I agree to remain adaptable and open to change, understanding that the process of personal growth and support may involve unexpected shifts. I will be willing to try new approaches, perspectives, and strategies, even if they feel uncomfortable at first. I recognize that transformation often requires flexibility and patience.

  4. Honesty and Forthrightness
    I pledge to be honest and transparent with Triumph Ova Struggles Advocacy and Consulting about my thoughts, feelings, needs, and challenges. I understand that being forthright is essential for the provider to offer the most relevant and tailored support. I acknowledge that withholding information or being less than truthful may hinder the effectiveness of the services I receive.

  5. Punctuality and Cancellation Policy
    I understand that punctuality is important for making the most of my sessions. I agree to arrive on time for all scheduled appointments. I will inform Triumph Ova Struggles Advocacy and Consulting as soon as I am aware that I will be running late. If I am more than 15 minutes late for my appointment, rescheduling may be necessary depending on availability. If I need to cancel or reschedule, I will provide at least 24 hours' notice to be eligible for a refund. If I cancel with less than 24 hours' notice, I understand that I will not receive a refund but may reschedule my session. No-shows without prior notice will not be eligible for rescheduling or a refund. Rescheduled appointments are not eligible for refunds.

By engaging with Triumph Ova Struggles Advocacy and Consulting, I acknowledge that I have read, understand, and agree to the terms outlined in this Declaration of Agreement. I affirm that I am fully committed to these principles, and I acknowledge that they will guide our work together. I understand that only through my active participation and dedication to these values will I receive the best possible support from Triumph Ova Struggles Advocacy and Consulting.
